Kendrapara: A case of instant “triple talaq” was registered in Pattamundai in Kendrapara district after a man allegedly divorced his wife over phone and said “talaq” thrice. The matter came to light days after the Triple Talaq Bill passed by both houses of Parliament became a law after getting the President’s assent.
The accused identified as Abu Sufiyan Khan, was booked under the newly-enacted Muslim Women (Protection of Rights On Marriage) Act, 2019 earlier this month. The incident happened in ward no-11 in Pattamundai NAC under Pattamundai Model police station in Kendrapara district here recently.
Sufiyan, who is working in Hyderabad, divorced his wife Rubina Khatoon by uttering ‘talaq’ three times over phone recently.
According to reports, Rubina and Sufiyan were in love for seven years and they had a registered court marriage one and a half year ago. After the marriage Rubina accompanied his husband to his working place in Hyderabad. Later Sufiyan dropped Rubina at his house in Kendrapara and went back to Hyderabad when the latter got pregnant.
During this time, Rubina alleged that she was subjected to mental and physical harassment by her in-laws regularly.
“I informed my husband about the torture meted out to me. He asked me to go to my house and stay there till delivery. After I delivered a baby girl, I tried to return my in-laws house but they opposed. I intimated the same to my husband. He said that he did not know me and gave me instant divorce over phone by uttering talaq thrice,” said the victim woman.
Unable to bear the trauma I approached police seeking justice. Now, they (husband and in-laws) are saying me to settle the case by taking Rs 2.30 lakh.
The Muslim Women (Protection of Rights on Marriage) Act, 2019 – makes talaq-e-biddat or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband void and illegal.
